The judgment of a court may comprise within it a combination of discourses, corresponding to the different audiences which the judge (in fact, if not in intention) is addressing. It may contain the justification directed at the parties to the litigation. It may contain the justification which the judge would have the legal profession understand to lie behind it. At the same time, it may include other forms of justificatory discourse, directed to other kinds of audience. I doubt not, for example, that some judges are looking over their shoulders (even subconsciously, if one can do that) at the media, and providing levels of justification more appropriate for a popular audience.
Arnaud devotes a major section of his analysis of francophone sociology of law to semiotic approaches (1981, Pt. III). In them, he stresses the plurality of “legal systems”, from the official to those of the “droit vécu”.
